Statement on House Letter Urging the Administration to Finalize Reforms to Stark Law and Anti-Kickback Statute
Premier thanks Roger Marshall (R-KS), Ron Kind (D-WI), Markwayne Mullin (R-OK), Ami Bera (D-CA), Mike Kelly (R-PA), Raul Ruiz (D-CA), Brad Wenstrup (R-OH) and Tony Cardenas (D-CA) for their leadership in advancing value-based care by pressing the Administration to finalize regulations to modernize the Medicare Anti-Kickback Statute and Stark Physician Self-Referral Law. These 1980’s rules are now impeding the movement to value-based care models and increasing provider burden. New models of care are tied to measurable quality outcomes and cost improvements. As a result, these models remove the underlying incentives for greater volume of expensive services that led to the law in the first place. These changes are critically needed to continue this positive movement to value-based care.
Premier is concerned that the Centers for Medicare & Medicaid Services has extended the deadline for releasing the final Stark Law regulation until August 2021. We urge the Administration to move quickly to reform these antiquated laws, which are impeding alignment and collaboration among healthcare providers.
